absolutely transferred to Moses their right to consult God and interpret His
commands此for they do not here promise obedience to all that God shall
tell them察 but to all that God shall tell Moses see Deut。 v20 after the
Decalogue察 and chap。 xviii15察 16。 59 Moses察 therefore察 remained the
sole promulgator and interpreter of the Divine laws察and consequently also
the sovereign judge察who could not be arraigned himself察and who acted
among the Hebrews the part察of God察in other words察held the sovereign
kingship此he alone had the right to consult God察to give the Divine answers
to the people察and to see that they were carried out。 60 I say he alone察for
if anyone during the life of Moses was desirous of preaching anything in
the name of the Lord察he was察even if a true prophet察considered guilty and
a usurper of the sovereign right Numb。 xi28 Endnote 30А 61 We may
here notice察 that though the people had elected Moses察 they could not
rightfully elect Moses's successor察 for having transferred to Moses their

right of consulting God察 and absolutely promised to regard him as a
Divine oracle察they had plainly forfeited the whole of their right察and were
bound to accept as chosen by God anyone proclaimed by Moses as his
successor。 62 If Moses had so chosen his successor察who like him should
wield the sole right of government察possessing the sole right of consulting
God察 and consequently of making and abrogating laws察 of deciding on
peace or war察 of sending ambassadors察 appointing judges ´ in fact察
discharging all the functions of a sovereign察the state would have become
simply a monarchy察only differing from other monarchies in the fact察that
the latter are察 or should be察 carried on in accordance with God's decree察
unknown even to the monarch察whereas the Hebrew monarch would have
been the only person to whom the decree was revealed。 63 A difference
which increases察 rather than diminishes the monarch's authority。 64 As
far as the people in both cases are concerned察 each would be equally
subject察 and equally ignorant of the Divine decree察 for each would be
dependent on the monarch's words察and would learn from him alone察what
was lawful or unlawful此nor would the fact that the people believed that
the monarch was only issuing commands in accordance with God's decree
revealed to him察 make it less in subjection察 but rather more。 176А 。65
However察Moses elected no such successor察but left the dominion to those
who came after him in a condition which could not be called a popular
government察nor an aristocracy察nor a monarchy察but a Theocracy。 66 For
the right of interpreting laws was vested in one man察while the right and
power of administering the state according to the laws thus interpreted察
was vested in another man see Numb。 xxvii21 Endnote 31А
1767 In order that the question may be thoroughly understood察I will
duly set forth the administration of the whole state。
68 First察 the people were commanded to build a tabernacle察 which
should be察 as it were察 the dwelling of God ´ that is察 of the sovereign
authority of the state。 69 This tabernacle was to be erected at the cost of
the whole people察not of one man察in order that the place where God was
consulted might be public property。 70 The Levites were chosen as
courtiers and administrators of this royal abode察while Aaron察the brother
of Moses察was chosen to be their chief and second察as it were察to God their

King察being succeeded in the office by his legitimate sons。
1771 He察as the nearest to God察was the sovereign interpreter of the
Divine laws察 he communicated the answers of the Divine oracle to the
people察and entreated God's favour for them。 72 If察in addition to these
privileges察 he had possessed the right of ruling察 he would have been
neither more nor less than an absolute monarch察 but察 in respect to
government察he was only a private citizen此the whole tribe of Levi was so
completely divested of governing rights that it did not even take its share
with the others in the partition of territory。 73 Moses provided for its
support by inspiring the common people with great reverence for it察as the
only tribe dedicated to God。
1774 Further察 the army察 formed from the remaining twelve tribes察
was commanded to invade the land of Canaan察 to divide it into twelve
portions察 and to distribute it among the tribes by lot。 75 For this task
twelve captains were chosen察 one from every tribe察 and were察 together
with Joshua and Eleazar察 the high priest察 empowered to divide the land
into twelve equal parts察and distribute it by lot。 76 Joshua was chosen for
the chief command of the army察inasmuch as none but he had the right to
consult God in emergencies察 not like Moses察 alone in his tent察 or in the
tabernacle察but through the high priest察to whom only the answers of God
were revealed。 77 Furthermore察he was empowered to execute察and cause
the people to obey God's commands察transmitted through the high priests察
to find察 and to make use of察 means for carrying them out察 to choose as
many察army captains as he liked察to make whatever choice he thought best察
to send ambassadors in his own name察 and察 in short察 to have the entire
control of the war。 78 To his office there was no rightful successor ´
indeed察 the post was only filled by the direct order of the Deity察 on
occasions of public emergency。 79 In ordinary times察all the management
of peace and war was vested in the captains of the tribes察as I will shortly
point out。 80 Lastly察all men between the ages of twenty and sixty were
ordered to bear arms察and form a citizen army察owing allegiance察not to its
general´in´ chief察nor to the high priest察but to Religion and to God。 81
The army察or the hosts察were called the army of God察or the hosts of God。
82 For this reason God was called by the Hebrews the God of A
